1. Object / organizer
These conditions of participation and the data protection notices regulate participation in the competition organised by FEIN Power Tools Inc., 1000 Omega Drive, Suite 1180, Pittsburgh, PA 15205 (hereinafter referred to as the "organiser") by participants and the collection and use of data collected from or provided by participants.
By participating in the competition, the participants accept these conditions of participation.
2. Participation conditions and procedure
The competition begins on 10/01/13 and ends on 12/31/13.
Anyone of full legal capacity, aged 18 or over and legal resident in the United States of America is entitled to participate. People from other countries may not take part.
Participation with a forged identity or the identity of another person is not permitted.
The prizes are: 1. Prize: One FEIN Cordless 4 speed drill/driver and SuperCut set (ASCM 18 QX + AFSC 18); 2. Prize: Three iPad Mini 16GB; 3. Prize: Five FEIN MultiMaster Start Q Sets.
Participants must answer the questions in the competition.
The winners will be determined by random selection.
Participants who violate the participation conditions or manipulate the drawing may be immediately excluded from participation in the competition. If conditions for exclusion exist, prizes may be subsequently denied and return of previously distributed prizes demanded.
The organiser and/or the agents appointed to run the competition are entitled to discontinue, abort or suspend the competition if:
Payment of the prize in cash, property, or its exchange or transfer to another person is excluded. A participant can reject the prize. In that case, a new winner will be established through a new drawing. Delivery of the prizes will be individually coordinated with the participants.
Participants will be promptly notified about the prizes by email to the registered email address or by mail and asked for confirmation.
If a participant does not confirm acceptance of the prize within 4 weeks, the prize is forfeited. If the stated contact details are incorrect (e.g. invalid email addresses), the organizer is not obliged to find correct addresses. Participants are responsible for any harm caused by giving incorrect contact data.
4. Warranty disclaimer
The organizer makes no guarantee concerning the availability and functioning of the drawing. The drawing can be terminated and removed due to external circumstances or constraints without creating grounds for participant claims against the organizer.
Such circumstances may include technical problems or changes to the rules.
The organizer is liable without limitation, insofar as the cause of damage is due to willful intent or gross negligence.
The organizer is also liable for simple negligent breach of material obligations, the breach of which endangers the achievement of the objective of the contract, or for breach of obligations, the fulfillment of which enable the orderly performance of the contract in the first place and on which the contractual partners regularly rely. However, in this case, the organizer is only liable for reasonably foreseeable damages typical of the contract. The organizer is not liable for simple negligent breach of obligations other than those in the afore-mentioned sentences.
The afore-mentioned limitations of liability shall not apply to injury to life, limb and health, for a defect after assumption of a guarantee of product quality or for fraudulently concealed defects. Liability under product liability law remains unaffected.
Insofar as the organizer's liability is excluded or limited, this also applies to the personal liability of the organizer's employees, representatives and vicarious agents.
5. Data protection notice
The organizer only collects, stores and uses participant data to the extent permitted or required by law or to which participants have given their consent.
The following details are legally collected from the participants by the organiser and are used to design, run and process the competition: name of participant, e-mail address. This data is stored for the archiving periods prescribed by law. The aforementioned data may only be used for electronic advertising purposes with the specific consent of the participant. This consent is provided using a double opt-in process, i.e. an e-mail (known as a checkmail) is sent to the e-mail address provided by the participant, asking the participant to again confirm his or her consent to receiving electronic advertising. Only once this has been confirmed will the e-mail address be activated for electronic advertising. The consent can be withdrawn at any time with immediate effect without the need for a specific form.
